An investigation into an incident on a Florida roadway known for its high crash rate is still ongoing after a serious motorcycle accident took place. A 42-year-old man caused an accident which sent two motorcycle riders to the hospital with injuries, and then fled the scene.
The man was not paying attention when he pulled out of a gas station right in front of the motorcycle. The motorcycle hit the man's Kia sedan in the driver-side door and the impact sent the two bikers flying off the bike. The two riders - a man who was driving and his female passenger - were taken to Bayonet Point Hospital. Both were in critical condition.
The man in the Kia sedan did not wait to see if the motorcyclists were injured. He did not wait for the police, either. Instead, he left the scene. Police caught up with him at his house and arrested him. He was charged with driving under the influence of alcohol and leaving the scene of an accident with serious bodily injury.
Police also discovered that the driver of the car had been drinking. When police caught up to the man, he had a blood alcohol level of about 0.15. Florida's legal limit is 0.08. The man's blood-alcohol level was almost twice that of the state's limit.
Florida has no fault insurance. If a person gets in an accident, the claim is paid by the person's own insurance. Every driver in Florida must have Personal Injury Protection, also known as PIP. However, Florida law does not allow motorcycle drivers to carry PIP on a motorcycle and a person's car insurance coverage cannot cover motorcycle crash injuries. For victims who are involved in a motorcycle accident, there may be many challenges that involve medical bills and other payments. In these cases, it may be helpful to speak with an attorney.
